Your Use of Our Services

Our Services should be used by eligible users only. Eligible users are individuals who belong to organisations that are active clients, which means clients that are paying for our Services under contract or trialling our services for a period of time. If you are using our Services and you no longer belong to an active client organisation, please stop using our Services and notify us of your change in eligibility. There are exceptions to this term, such as if you are an employee, supplier or other associate of Curation who has been given our explicit permission to use our Services. We reserve the right to revoke your access to our Services.

If you are using our Services on behalf of a business, that business accepts these terms.

If you are an eligible user, Curation gives you a personal, worldwide, non-assignable and non-exclusive licence to use our Services. This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Services provided by Curation in the manner permitted by these terms or any other contractual terms set out between Curation and your organisation.

You may need a Curation Account to use some of our Services. You may create your own Curation Account, or it may be assigned to you by an administrator from either Curation or your organisation. To protect your Curation Account, please use a secure password and keep it confidential.

Unless otherwise stated, we or our licensors own the intellectual property rights in the Services and the content contained within our Services. All our intellectual property rights are reserved. Unless explicitly stated by the contract between Curation and your organisation, using our Services does not give you ownership of any intellectual property rights in our Services or the content contained within our Services. Unless explicitly stated by the contract between Curation and your organisation, you may not copy, modify, distribute, re-publish, sell or lease any part of our Services or the content contained within our services, nor may you reverse engineer or attempt to extract the source code of any software used to deliver our Services, unless laws prohibit those restrictions.

In connection with your use of our Services, we may send you service announcements or administrative messages. In addition, as part of our contractual obligations stated by any contract between Curation and your organisation, we may send you other information such as emails inviting you to register for our Services, or periodic emails notifying you of newly published content or newly released features within our Services. You may be able opt out of some of those communications. These terms do not give us permission to send you marketing communications.

Some of our Services allow you to contribute content for publication in our Services. For example, you may choose to contribute your comments relating to a piece of content within our Services, or contribute and comment on a piece of content on a third-party service or website. Unless otherwise stated in the contract between Curation and your organisation, when you contribute or store content to or within our Services, you give Curation a worldwide licence to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes that we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights that you grant in this licence are for the limited purpose of operating, promoting and improving our Services, and to develop new ones. This licence continues even if you stop using our Services. In some cases there may be exceptions to this term, such as when you contribute content you expressly state should be distributed only via our Services to other users within your organisation.

Your Privacy

Curation's Privacy Policy explains how we treat your personal data, how we protect your privacy when you use our Services, and how you can control the personal data that we store about you. By using our Services, you agree that Curation can use your data in accordance with our Privacy Policy.

Our Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill, care, and attention to your security, safety and privacy. But there are certain things that we do not promise about our Services and certain things that we need to make clear to you.

Unless explicitly stated by the contract between Curation and your organisation, Curation does not make any specific promises about our Services. For example, we do not make any commitments about the specific functions of our Services, such as their reliability, availability or ability to meet your needs, nor do we make any commitments about the content contained within our services, such as its reliability, availability or ability to meet your needs. We provide the Services “as is”. Some jurisdictions provide for certain warranties. To the extent permitted by law, we exclude all warranties. When permitted by law, Curation and Curation's suppliers and distributors will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential, exemplary or punitive damages. To the extent permitted by law, the total liability of Curation and its suppliers and distributors for any claims under these terms, including for any implied warranties, is limited to the amount that you paid us to use the Services. In all cases, Curation and its suppliers and distributors will not be liable for any loss or damage that is not reasonably foreseeable.

What data we collect and store about you

Curation collects the minimum amount of data reasonably required to deliver and improve our service. Our business model does not require us to exploit your data -  we have no interest in selling your data or monetising it in any way.

To deliver and improve our service we we may collect and store the following information about you:

  • Your name
  • Your email address
  • Your telephone number
  • Your company or employer name
  • Your job title
  • The IP address(es) you use to access our Services
  • The date, time and nature of interactions you make with our Services, such as logging into our Service, opening emails, visiting web pages or reading pieces of content (we use Cookies and similar technologies to do this)
  • Any contributions you choose to make to our services, such as your comments relating to a piece of content within our Services
  • Any other communications that you choose to send us, such as feedback or support requests

Why we collect and store data about you

The primary reason we collect and store data about you is to effectively provide our Services to you. For example, we need your name, email address and telephone number to contact you with important service-related information or respond to support requests you may make. We need your email address, company or employer name and job title to validate that you are an eligible user of our Service, for example you belong to an organisation that is an active client that is paying for our Services under contract or trialling our services for a period of time. For example, our ability to monitor email open rates may allow us to optimise the frequency of emails to better suit your needs, or our ability to monitor your interactions with our Services may help us improve how the service works or create content that better meets your needs. We may also use your interactions to provide you with personalised services, for example, if we determine that you are interested in a particular subject, our service may deliver you more content on that subject in the future.

In some cases, as defined in a contract that may exist between Curation and your organisation, we are also obliged to collect and store data about you in order to report back to your organisation on your usage and engagement with our Services. This reporting may include personally identifiable information, from any interactions you make with the service, to any comments you may choose to share on our content. Such data will only ever be shared with your organisation and within the scope defined by the contact we have with your organisation; if you have any specific questions about this you should contact your organisation directly.

How you can access, manage, or delete your data

Some of your data can be accessed and managed directly within our Services that you use. For example, within the ‘Settings’ section on our online platform, you can view some of your information and manage the nature and amount of emails you have chosen to receive as part of your service.

To access all of the data we collect and store about you, simply email us at info@curationcorp.com and we will send you a full report within 30 days of your request. Subsequently, if you wish any data to be updated, or deleted, let us know and we will do this. Please note that in some cases, as defined in a contract that may exist between Curation and your organisation, we are obliged to provide reports to your organisation that may include data about you; in cases where we have already shared data about you, we may have no longer ability to manage or delete this data on your behalf. Please also note that in some cases, as defined in a contract that may exist between Curation and your organisation, we are required to retain data we collect and store about you for a period of time, for example six months (even in cases where you may have stopped using our Services). In this case we may have to coordinate with your organisation with regards to your request; regardless of this, we will always fulfil our legal obligations.

Our approach to ensuring the security of your data

Encryption brings a higher level of security and privacy to our services, and when you do things like login to our services or submit data such as your personal information or comment on a piece of content, we protect this data with multiple layers of security, including industry-standard encryption technology.

Our cloud infrastructure protects your data 24/7, we use industry-standard cloud services to store your data, and we use monitoring services to ensure your data remains secure and to quickly act on any security issues that may arise. We will notify affected users if we identify security issues such as data breaches.

Other disclosures

In addition to the terms outlined elsewhere in this policy, we may disclose information about you:

(a) to the extent that we are required to do so by law;

(b) in connection with any legal proceedings or prospective legal proceedings;

(c) in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk); and

(d) to the purchaser or seller (or prospective purchaser or seller) of any business or asset which we are (or are contemplating) selling or purchasing.

Curation takes its users’ privacy concerns seriously. If you believe that Curation has not complied with this privacy policy, or the law, with respect to you personal data, please contact us, directing correspondence to the Data Protection Officer at Curation. In your correspondence please describe as much as possible the ways you believe that Curation has not complied with this policy, or the law, and we will investigate your complaint quickly and comprehensively.
